Redundancy
Unfortunately in the current economic environment redundancy is becoming more and more a reality for Irish employers and employees. Redundancy is an area that is governed by a number of employment laws including the Redundancy Payments Act, Minimum Notice and Terms of Employment Act, Organisation of Working Time Act and the Equality Acts.
There are two main elements in redundancy payments (in addition to payments associated with notice or annual leave not taken). Firstly, Statutory Redundancy which is a payment determined by the Redundancy Payments Act and requires significant attention to detail. It is also a highly documented process. The second aspect of redundancy payments, which does not concern every employer, is ex gratia payments i.e. redundancy payments over and above those set down in legislation.
It is important not only for those leaving the employment but also for those remaining behind, that the process of redundancy is handled sensitively and professionally.
